Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the ChatODB mobile application and website (the "Service") operated by ZEHOE SOLUTIONS (M) SDN. BHD. ("Zehoe", "us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

1. Description of Service

ChatODB is an online platform that offers an On-Board Diagnostics (OBD) and Diagnostic Trouble Codes (DTC) fault code searching app and website. Our Service is designed to assist users in diagnosing issues with their vehicles by providing information on various DTC fault codes and OBD systems. The Service includes, but is not limited to, the following features:

a) Fault Code Database: ChatODB maintains an extensive database of DTC fault codes and descriptions for a wide range of vehicles, including cars, trucks, motorcycles, and other motorized vehicles. Users can search this database to find detailed information on specific fault codes, including possible causes, symptoms, and recommended solutions.
b) OBD System Information: The Service provides educational resources and guidance related to OBD systems, their functions, and their role in vehicle diagnostics. This may include information on different OBD protocols, communication methods, and diagnostic tools.
c) Diagnostic Tool Recommendations: Based on the user's vehicle and diagnostic requirements, ChatODB may recommend specific OBD scanning tools or software applications that can help users further diagnose and troubleshoot their vehicle's issues.
d) User Forum and Community: ChatODB offers a user forum and community platform where users can share their experiences, ask questions, and discuss various topics related to OBD systems, DTC fault codes, and vehicle diagnostics. This community-driven knowledge base allows users to learn from each other's experiences and insights.
e) Technical Support: The Service may provide limited technical support to users in the form of guides, tutorials, and troubleshooting tips. However, ChatODB does not offer professional mechanical or automotive advice, and users are encouraged to consult a professional technician for any diagnostic or repair services.

Please note that the ChatODB Service is intended for informational purposes only and should not be relied upon as a sole source for diagnosing or repairing your vehicle. Users are responsible for ensuring that any information obtained from the Service is accurate and relevant to their specific situation, and for using this information at their own risk.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Zehoe, its affiliates, directors, employees, partners, agents, suppliers, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the ChatODB Service; (ii) any conduct or content of any third party on the Service, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; (iii) any content obtained from the Service; or (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not Zehoe has been informed of the possibility of such damage, even if a remedy set forth herein is found to have failed its essential purpose.

You expressly acknowledge and agree that your use of the ChatODB Service is at your sole risk and that the entire risk as to satisfactory quality, performance, and accuracy is with you. Zehoe does not warrant that the Service will meet your specific requirements, that the Service will be uninterrupted or error-free, that the results obtained from the use of the Service will be accurate or reliable, or that any errors in the Service will be corrected.

Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you. If any limitation or exclusion of liability set forth in this section is held to be invalid or unenforceable for any reason, the aggregate liability of Zehoe under such circumstances for liabilities that otherwise would have been limited shall not exceed the aforementioned amount.

Indemnification

You agree to indemnify, defend, and hold harmless Zehoe, its affiliates, directors, employees, partners, agents, suppliers, and licensors from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

your access to, use of, or inability to use the ChatODB Service;
your violation of these Terms and Conditions, any applicable laws, rules, or regulations, or any third-party rights, including without limitation any copyright, property, or privacy rights;
any content, information, or materials that you submit, transmit, or otherwise make available through the Service; or
any misrepresentation made by you.

Zehoe reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of Zehoe. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

This indemnification obligation will survive the termination or expiration of these Terms and Conditions and your use of the ChatODB Service.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. By using the ChatODB Service, you expressly agree that the exclusive jurisdiction for any claim or dispute arising out of or relating to these Terms and Conditions or your use of the Service resides in the courts located in Malaysia, and you consent to the exercise of personal jurisdiction in such courts for the purpose of litigating any such claim or action.

If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions of these Terms and Conditions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms and Conditions will not be considered a waiver of those rights. If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court, the remaining provisions of these Terms and Conditions will remain in effect. These Terms and Conditions constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify, amend, or replace these Terms and Conditions at any time. When we make changes to the Terms, we will update the "Last Updated" date at the beginning of this document. It is your responsibility to regularly review these Terms and Conditions for any updates or changes.

By continuing to access or use the ChatODB Service after any revisions to the Terms and Conditions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service immediately.

We encourage you to review the Terms and Conditions periodically to stay informed about any updates or changes that may impact your use of the ChatODB Service. Your continued use of the Service following the posting of any changes to the Terms and Conditions signifies your acceptance of those changes.

Intellectual Property

The ChatODB Service and its original content, features, and functionality are and will remain the exclusive property of Zehoe and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of both the Malaysia and foreign countries.

All trademarks, service marks, logos, trade names, and any other proprietary designations of Zehoe used herein are trademarks or registered trademarks of Zehoe. You are not granted any right, title, or interest in or to the ChatODB Service or its content, features, and functionality, except for the limited, non-exclusive, non-transferable, and revocable license to access and use the Service in accordance with these Terms and Conditions. Any unauthorized use, reproduction, modification, distribution, or exploitation of the Service or its content is strictly prohibited and may result in civil and/or criminal penalties.

By submitting, posting, or displaying any content, information, or materials on or through the Service, you grant Zehoe a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with the ChatODB Service and Zehoe's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the ChatODB Service (and derivative works thereof) in any media formats and through any media channels. You represent and warrant that you have all rights, power, and authority necessary to grant the rights granted herein to any content submitted.

User Conduct

By accessing and using the ChatODB Service, you agree to abide by the following rules of conduct:

You will not use the Service for any unlawful purposes or engage in any conduct that is prohibited by these Terms and Conditions or any applicable laws, rules, or regulations.
You will not impersonate any person or entity, falsely claim an affiliation with any person or entity, or access the accounts of others without permission, forge another person's digital signature, misrepresent the source, identity, or content of information transmitted via the Service, or perform any other similar fraudulent activity.
You will not attempt to gain unauthorized access to the Service, its computer systems, or networks connected to the Service through hacking, password mining, or any other means.
You will not use the Service to transmit, distribute, or store any material that is defamatory, obscene, threatening, abusive, harassing, or otherwise violates the rights of any third party, including without limitation, any intellectual property rights, privacy rights, or rights of publicity.
You will not use the Service to distribute unsolicited promotional or commercial content or other unwanted or mass solicitations.
You will not interfere with or disrupt the integrity or performance of the Service, or the computers, networks, or data used to provide the Service, or attempt to gain unauthorized access to the Service or its related systems or networks.
You will not use any automated means, including bots, crawlers, spiders, or data mining tools, to access, monitor, download, or use any portion of the Service or its content, except with the express written permission of Zehoe.
You will not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying ideas or algorithms of any part of the Service, except to the limited extent that applicable laws specifically prohibit such restriction.
You will not modify, adapt, sublicense, translate, sell, or create derivative works based on any part of the Service without the express written permission of Zehoe.
You will not take any action that imposes, or may impose, an unreasonable or disproportionately large load on the infrastructure of the Service or Zehoe's systems or networks, or any systems or networks connected to the Service.

By using the ChatODB Service, you acknowledge and agree that any violation of these rules of conduct may result in the immediate termination of your access to the Service, without prior notice, and may expose you to civil and/or criminal liability.

Termination

Zehoe reserves the right to terminate or suspend your access to and use of the ChatODB Service, at any time and for any reason, at our sole discretion, without prior notice or liability. Possible reasons for termination or suspension may include, but are not limited to, your breach of these Terms and Conditions, applicable laws, rules, or regulations, or any conduct that is detrimental to the operation of the Service or the interests of Zehoe or its users.

Upon termination or suspension of your access to the Service, your right to use the Service will immediately cease, and any data or content associated with your account may be deleted or made inaccessible. You agree that Zehoe shall not be liable to you or any third party for any termination or suspension of your access to the Service, or for the deletion or inaccessibility of any data or content associated with your account.

All provisions of these Terms and Conditions which, by their nature, should survive termination or suspension, shall survive termination or suspension, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account and discontinue your use of the ChatODB Service at any time by contacting Zehoe at hello@zehoe.com. Please note that if you choose to terminate your account, any data or content associated with your account may be deleted or made inaccessible, and Zehoe shall not be liable for any losses or damages arising from such deletion or inaccessibility.
